Divorce/Inheritance

Divorce (divorce by court, divorce by agreement), alimony, division of property

Divorce refers to the legal act of dissolving the marital relationship between husband and wife, and our law stipulates divorce by agreement (consultative) and divorce in court as the types of divorce.
If there is no agreement on divorce between the parties, especially if one of the parties does not agree to the divorce, the court has no choice but to proceed with the divorce proceedings (divorce litigation).
However, in the case of a divorce in court, it can be recognized only when there are six reasons for divorce as stipulated in the Civil Act.

Inheritance/will consulting

As the application of the tax law on inheritance becomes stricter and the burden increases, it is necessary to prepare for inheritance in the long term to avoid major losses.
At ELAW, we have prepared inheritance and will consulting with related experts such as tax accountants in order to minimize the burden of taxes while proceeding with the inheritance in the way the client wishes.

Claim for division of inherited property, claim of return for secured portions

Secured portions is a system stipulated by the Civil Act so that heirs can be compensated for the infringed portion in the event that the property of the inheritance share they will receive is infringed.

In recent years, it has become one of the most problematic aspects about inheritance.
In the past, it was common for the eldest son to inherit most of their parents' fortunes, but now all children receiving an equal inheritance has become the norm.br> In case of infringement of secured portions, a claim must be made within the statute of limitations of one year, so it is necessary to immediately consult with an expert.

Other family law

Regarding family issues, other issues include:

  • Adoption issues such as adoption and dissolution of the child,
  • Paternity verification issues such as denial of paternity after paternity or denial of the biological child after paternity verification,
  • Claiming child support after divorce such as child support payment.

Consult with lawyers for these issues as well to find out whether they are in motion or not.
